It contributes to the breaching of the Energy Community\u2019s environmental standards and prevails Serbia to align with the EU\u2019s 2030 climate targets, as well as its ambitions to become a Member State of the EU.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Serbian thermal power plants are among Europe\u2019s biggest emitters of sulfur dioxide (SO<span class=\"subscript\">2<\/span> ) \u2013 a harmful gas released when burning coal, which contributes to the formation of acid rain and secondary particulate matters, creating a significant threat to human health and the environment. EPS\u2019 emissions are a serious public health hazard to the citizens of Serbia and the neighbouring countries in the Western Balkans and the EU.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:image {\"id\":2894} --><\/p>\n<figure class=\"wp-block-image\"><img decoding=\"async\" class=\"wp-image-2894\" src=\"https:\/\/www.reri.org.rs\/wp-content\/uploads\/2021\/01\/SO2-NERP-vs-EPS_2018-EN-1024x640.png\" alt=\"\" \/><\/figure>\n<p><!-- \/wp:image --><\/p>\n<p><!-- wp:image {\"id\":2895} --><\/p>\n<figure class=\"wp-block-image\"><img decoding=\"async\" class=\"wp-image-2895\" src=\"https:\/\/www.reri.org.rs\/wp-content\/uploads\/2021\/01\/SO2-NERP-vs-EPS_2019-EN-1024x640.png\" alt=\"\" \/><\/figure>\n<p><!-- \/wp:image --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Kostolac B thermal power plant is the largest single SO<span class=\"subscript\">2<\/span> polluter in Europe, which in 2018 emitted 79,113 tons of SO<span class=\"subscript\">2<\/span>, over 25,000 tonnes higher than the total annual SO<span class=\"subscript\">2<\/span> limit for all twelve of Serbia\u2019s Public Electricity Company\u2019s (EPS) thermal power plants. Serbian thermal power plant Nikola Tesla is also among the top 10 SO<span class=\"subscript\">2<\/span> polluters in Europe.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>As a party to the Energy Community Treaty, Serbia is legally obliged to reduce emissions of SO<span class=\"subscript\">2<\/span> , nitrogen oxides (NO<span class=\"subscript\">x<\/span>) and particular matter (PM) by applying the National Emission Reduction Plan (NERP)<span class=\"fusnota\">2<\/span> as from 1 January 2018<span class=\"fusnota\">3<\/span>. However, ten of EPS\u2019s thermal power plants covered by the NERP emitted 336,000 tonnes of SO<span class=\"subscript\">2<\/span> in 2018 and 309,500 tonnes in 2019, while the maximum NERP annual threshold was 54,000 tonnes per year.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Jovan Raji\u0107, RERI\u2019s Lead Attorney said: \u201cThe obligation for Serbia to implement the NERP, and for EPS to comply with annual emission ceilings, was clear and undoubtful since January 2018. It would contribute to the reduction of harmful health impact to the citizens of Serbia and EU as well. This lawsuit is to secure proper implementation of the NERP and to strengthen accountability mechanisms for reduction of pollution from thermal power plants.\u201d<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Complying with environmental standards will help to smooth the coal phasing out transition, which is an inevitable step for the country which has the aspiration to become a part of carbon neutral Europe. People suffering from asthma and heart and lung diseases are at particular risk.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p><span class=\"fusnota\">1<\/span>\u00a0RERI earlier filed the requests for extraordinary inspection surveillance of each plant covered by the NERP and operated by the EPS, requesting from the inspection to order the operator to take specific actions\/measures in order to comply with its obligations under the Energy Community Treaty. However, the inspection claimed that there is no penalty in the event that the operator fails to comply with the provisions from the national plan.
